The Immigration and Nationality Act (INA) is the primary body of law governing the immigration laws of the United States. Needless to say, the INA covers a vast array of cases, processes, and agencies. The big three agencies are USCIS/DHS, EOIR, and the DOS. A brief summary of each agency, and the types of processes/cases are as follows:

  • The U.S. Citizenship and Immigration Services (USCIS) is the government agency that oversees lawful immigration to the United States. Most cases begin with USCIS, whether your cases involves a petition for family member, employee, investor visa, self-petition (VAWA) or naturalization (citizenship). This agency provides the forms, collects the fees, conducts interviews, adjudicates all the aforementioned cases, and more. At Mubarak Law, we have successfully handled hundreds of cases at the Orlando USCIS office.   • USCIS is a division of the U.S. Department of Homeland Security, as is Immigration Customs and Enforcement (ICE) and Customs and Border Patrol (CBP). ICE enforces federal laws governing border control, customs, trade, and immigration to promote homeland security and public safety. CBP has a similar description as ICE. However, CBP agents are mostly encountered at border crossings and ports of entry, like airports.
  • The Executive Office of Immigration Review (EOIR), is a division of the Department of Justice (DOJ). The EOIR is the government agency which governs “the Immigration Court.” Individuals whom are in deportation proceedings or removal proceedings will have their Master Calendar Hearings, Individual Calendar Hearings, and Bond Proceeding hearings at the EOIR court. If you or a family member have been issued a Notice to Appear with charges initiating removal proceedings, an experienced immigration attorney should be contacted immediately.   • The Department of State is a large agency. The primary immigration components are related to U.S. passports, U.S. Embassies, and U.S. consulates. After one naturalizes or becomes an American citizen, they are not provided with a U.S. passport immediately. The U.S. passport must be applied for through the U.S. Department of State. For individuals whom have petitioned for individuals abroad (whether it is family members, employees, or individuals seeking investor visas), they must complete Department of State forms and attend an interview at a local U.S. consulate to obtain their visa.
